This platform is operated by Mitsooz. Throughout the site, the terms "we", "us" and "our" refer to Mitsooz. Mitsooz offers this website, including all information, tools, and curatorial services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site or engaging in an acquisition from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"). These Terms apply to all users of the site, including collectors, artists, studios, and contributors of content.
Please read these Terms carefully before accessing our platform. By accessing any part of the site, you agree to be bound by these Terms. Our platform is hosted on Shopify Inc. which provides the online commerce infrastructure that allows us to represent our founding artists and studios to you.
SECTION 1: ONLINE PLATFORM TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our platform for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. This includes, but is not limited to, copyright and intellectual property laws. A breach or violation of any of the Terms will result in an immediate termination of your access to our Services.
SECTION 2: GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service or access to the Service without express written permission by us.
SECTION 3: THE STUDIO-DIRECT MODEL
Mitsooz operates as a curated platform connecting collectors directly to original works from independent artists and studios. While we facilitate the discovery and acquisition process, the fulfillment and physical integrity of the work are managed directly by the artist. By engaging in an acquisition, you acknowledge the unique nature of this studio-direct relationship.
SECTION 4: ACCURACY AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete, or current. The editorial and curatorial material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary sources of information. Any reliance on the material on this site is at your own risk.
SECTION 5: MODIFICATIONS TO THE SERVICE AND PRICING
Prices for our original works are subject to change without notice. We reserve the right at any time to modify or discontinue the Service or any part of our curation without notice. We shall not be liable to you or to any third party for any modification, price change, or discontinuance of the Service.
SECTION 6: ORIGINAL WORKS AND CURATED SERVICES
Certain original works and authorized editions may be available exclusively online through the website. These works have limited quantities and are subject to return only according to our Acquisitions and Returns protocol. We have made every effort to display as accurately as possible the colors and textures of the works that appear in our gallery. We cannot guarantee that your monitor's display of any color will be accurate.
We reserve the right to limit the sales of our works or Services to any person or geographic region. All descriptions of works and pricing are subject to change at any time without notice. We do not warrant that the quality of any works, services, or information obtained by you will meet your expectations.
SECTION 7: ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any acquisition request you place with us. In the event that we make a change to or cancel an acquisition, we may attempt to notify you by contacting the email provided at the time the request was made. You agree to provide current, complete, and accurate purchase and account information for all acquisitions made through our platform.
SECTION 8: PROHIBITED USES
In addition to other prohibitions as set forth in the Terms, you are prohibited from using the site or its content for any unlawful purpose. You may not infringe upon our intellectual property rights or the rights of our artists. Harassment, abuse, or discrimination against any individual based on race, religion, ethnicity, or disability is strictly prohibited. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
SECTION 9: LIMITATION OF LIABILITY
We do not guarantee that your use of our Service will be uninterrupted, timely, or error-free. You expressly agree that your use of the Service is at your sole risk. In no case shall Mitsooz, our directors, or our studio partners be liable for any injury, loss, or claim arising from your use of the platform or any works procured using the Service.
SECTION 10: GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States and the State of Oklahoma.

3. MOBILE TERMS OF SERVICE

The Mitsooz mobile message service is operated by Mitsooz. Your use of this service constitutes your agreement to these terms and conditions. We may modify or cancel the service or any of its features without notice. To the extent permitted by applicable law, we may also modify these mobile terms at any time and your continued use of the service following the effective date of any such changes shall constitute your acceptance of such changes.
CONSENT AND MESSAGING
By consenting to the Mitsooz SMS service, you agree to receive recurring text messages from and on behalf of Mitsooz through your wireless provider. These messages may be sent using an automatic telephone dialing system or other technology. Service related messages may include updates and information regarding acquisitions and account alerts. Promotional messages may include invitations to explore new curations, artist features, and editorial content from our journal.
Your participation in this program is completely voluntary and consent is not a condition of any acquisition with Mitsooz.
CHARGES AND FREQUENCY
We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS text messages.
OPT-OUT INSTRUCTIONS
You may opt-out of the service at any time. Text the single keyword command STOP to +1 866-975-1342 or click the unsubscribe link in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you.

LIMITATIONS AND RESPONSIBILITY
We may change any short code or telephone number we use to operate the service at any time. You acknowledge that any messages, including any STOP or HELP requests, sent to a number we have changed may not be received. We will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service.
